Acceptable Use & Safety Policy

1. The Basic Rule

Be funny. Be savage. Be pissed off. Don't be dangerous.

You are responsible for what you send. GiveTheFinger does not endorse user Messages merely because they are transmitted or displayed through our platform.

2. What Is Generally Allowed

Subject to applicable law and our Terms, GiveTheFinger may be used for expression such as:

• jokes;

• insults;

• satire;

• parody;

• criticism;

• trash talk;

• sports rivalries;

• political or cultural commentary;

• complaints about companies;

• expressions of frustration;

• humorous messages between friends;

• opinions; and

• other lawful expressive content.

Content does not violate this Policy merely because someone finds it rude, profane, insulting, embarrassing, controversial, or offensive.

3. Threats and Violence

Do not use GiveTheFinger to:

• make credible threats of violence;

• threaten physical injury or death;

• encourage or solicit violent acts;

• communicate plans to physically harm someone;

• glorify or encourage an imminent act of violence against an identifiable target; or

• intimidate a recipient through credible threats.

We may restrict content and accounts where we reasonably believe a communication presents a safety risk. Where appropriate and permitted by law, serious threats may be preserved or referred to law enforcement.

4. Harassment and Bullying

GiveTheFinger may not be used as a tool for unlawful harassment. Prohibited conduct includes:

• repeatedly targeting someone after measures have been imposed to stop communications;

• creating multiple accounts to circumvent restrictions;

• coordinating a campaign intended to terrorize or unlawfully harass a private person;

• encouraging others to overwhelm a private person with abusive communications;

• stalking;

• threatening a person's family;

• extortion;

• blackmail; or

• using GiveTheFinger as part of a broader unlawful campaign against an individual.

Context, frequency, severity, targeting, and credible safety concerns may be considered when enforcing this Policy.

5. Doxxing and Private Information

Do not post or transmit another person's highly sensitive private information without lawful authorization, including:

• Social Security or government identification numbers;

• passwords or authentication credentials;

• private financial-account information;

• payment-card numbers;

• nonpublic medical records;

• intimate images shared without consent;

• precise private home-location information when disclosed for a threatening or harmful purpose; or

• similarly sensitive information that creates a substantial risk of harm.

6. Sexual Exploitation

The following are prohibited:

• nonconsensual intimate imagery;

• threats to distribute intimate imagery;

• sexual extortion;

• sexual exploitation;

• sexual content involving minors; and

• content facilitating unlawful sexual exploitation or trafficking.

7. Illegal Activity

Do not use GiveTheFinger to facilitate:

• fraud;

• extortion;

• blackmail;

• trafficking;

• criminal threats;

• unlawful stalking;

• exploitation;

• unauthorized access to systems;

• distribution of unlawful content; or

• other criminal activity.

8. Spam and Platform Abuse

Do not:

• automate mass sending without authorization;

• scrape recipient or user information;

• circumvent rate limits;

• create accounts to evade enforcement;

• interfere with platform security;

• use stolen payment methods;

• attempt unauthorized access; or

• manipulate The Bird Feed, reactions, rankings, leaderboards, or other features through deceptive automation.

9. Minors

GiveTheFinger is intended for adults. Users must not use the Service to bully, sexually exploit, groom, threaten, intimidate, or otherwise endanger minors. Sexual content involving minors is strictly prohibited. Where GiveTheFinger becomes aware of content requiring reporting under applicable law, we may preserve and report that content as legally required.

10. Hate and Targeted Abuse

GiveTheFinger is not intended to facilitate unlawful discrimination or targeted abuse based upon legally protected characteristics. We may restrict content involving dehumanizing attacks, credible threats, incitement of violence, or severe targeted abuse. This does not prohibit lawful criticism, satire, debate, parody, or discussion concerning individuals, organizations, religions, political movements, countries, cultures, or public issues.

11. Defamation and False Information

Do not knowingly use GiveTheFinger to publish materially false statements of fact about another person where doing so would violate applicable law. Opinions, jokes, parody, rhetorical exaggeration, and satire are different from factual assertions, but users—not GiveTheFinger—are responsible for the legal character and accuracy of their submissions.

12. Impersonation

Do not impersonate another person or organization in a manner intended to deceive others about the source of a Message or to facilitate fraud or unlawful conduct.

13. The Bird Feed

The Bird Feed is public. Content eligible for private transmission is not necessarily eligible for public display. We may apply stricter standards to The Bird Feed because public publication can increase potential harm.

We may reject, remove, limit, de-identify, or decline to promote Bird Feed submissions in our discretion and subject to applicable law. Videos sent privately to recipients are not eligible for The Bird Feed unless GiveTheFinger expressly introduces such functionality.

14. Reporting Safety or Legal Concerns

Reporting something does not guarantee removal. GiveTheFinger may evaluate the circumstances, applicable law, these policies, and the rights of the sender and recipient. Knowingly submitting false or abusive reports may itself violate our policies.

15. No Duty to Monitor All Content

GiveTheFinger may moderate content but does not undertake an obligation to monitor every communication. The fact that we take action concerning one Message does not mean that we have reviewed, approved, or accepted responsibility for other Messages.

16. Changes

We may update this Policy as the Service, technology, law, and patterns of abuse evolve. Continued use of GiveTheFinger is subject to the version then in effect, subject to applicable law.

17. Enforcement

Depending upon severity and context, GiveTheFinger may:

• warn a user;

• reject a Message;

• prevent delivery;

• remove Bird Feed content;

• restrict recipient targeting;

• restrict sending frequency;

• suspend an account;

• permanently terminate an account;

• block associated accounts, payment methods, devices, or other identifiers where appropriate;

• preserve evidence;

• cooperate with valid legal process; or

• take other reasonable protective action.

We are not obligated to use progressively escalating enforcement. Serious violations may result in immediate termination.
